Hearing of case for Forcible Entry and Mandatory Temporary Injunction/Ejectment in respect of November 5 invasion and takeover of Boracay SandCastles Beach Resort and the ground floor of SandCastles--The Apartments. Hearing is before Malay-Buruanga Municipal Circuit Court, 9 am, Friday 19 December. Rebuttable of Viveca Hutchinson testimony by intruders Evangeline Dalino and Editha Cawaling Meren and presentation of intruders' witnesses with cross examination. Atty Mario Bihag, Jnr promised to finish up on 19 December after insisting to end Friday 12 December's session early on account of the man being "tired". (No consideration for the victims tiredness after 36 days kept captive in their own home with the mayor's sister ensconced on the ground floor!) Please come and make sure hearings end on December 19 so action can be taken quickly and a Merry Christmas can be had by ALL (except the lawbreakers!) so tourism can progress.

Hearing before Kalibo Regional Trial Court, Branch 9, of Motion for Reconsideration by Tribal Holdings/SandCastles for clarification of 24 Nov Ruling on Injunction in respect of Specific Performance/Damages case against Editha Cawaling Meren for her purporting to cancel registered lease, pre-paid til end-2010, that expires Dec 2019. Injunction became moot and academic as a result of Meren's invasion of SandCastles on Nov 5, 2008 as per Atty Oscar Tagamolila's manifestation to the Court. Tribal Holdings to pursue Specific Performance and Damages, with pre-trial set on 21 January 2009 as per Ruling of 24 November.

Concerned Boracaynons and Boracay Investors are notified of a hearing on the Motion for Mandatory Temporary Injunction at the Buruanga Municipal Court at 9am on Friday, 12 December. Your presence will underline the urgency of the matter of the armed invasion and occupation of Boracay SandCastles Beach Resort and part of SandCastles--The Apartments. None of us who support tourism in Boracay would want the siege of SandCastles to continue through Christmas-New Year.http://

Armed thugs reportedly took control of a beachfront hotel on the luxury Philippines resort island of Boracay yesterday, holding the Australian owner and his family captive in their apartment, the owner reported.

In a telephone interview, Greg Hutchinson said about a dozen “thugs” brandishing automatic weapons entered the grounds of the SandCastles Boracay Resort (www.boracaysandcastles.com) around 10 p.m. last Wednesday, forcing staff and guests to flee.

“We were in our third floor apartment when they barged in wearing ski masks and forced our guests and staff to leave,” Hutchinson said.

“As far as I know no shots were fired but they terrified the hell out of the staff and guests,” he added.

He said electricity and telephone connections to his apartment, which is next to the resort, have been cut and the emergency exit blocked with an industrial gas cylinder.

“It’s terrifying for my wife, Viveca, and five-year-old twins,” Hutchinson said.

Authorities said responding policemen forced the armed men to leave the resort, which is now being secured by police officers.

Hutchinson, who helped build Boracay into a world-renowned beach resort, said he has been the victim of an organized campaign to force him out of Boracay.

“When we opened SandCastles in 1989 there were just 10 resorts here... now there are over 100,” a shaken Hutchinson said.

“This type of intimidation has been going on for three years. We thought it had stopped,” he said. “This is the way things are done in the Philippines.”

“There are certain elements in the country who wait until you develop something, make a success of it and then they move in and force you out so they can reap the rewards.”

The current dispute is over Hutchinson’s 30-year lease, which still has 11 years to go.

Boracay police chief Superintendent Arnold Ardiente said he had offered Hutchinson and his family safe passage out of the resort but they refused to leave and were waiting for their lawyer.

“It is a civil dispute,” he said, denying there were still armed thugs on the premises.

“Police and security guards had been at the resort all night,” he said.

Police said tension had gripped the contested resort since the landowner and Hutchinson started the dispute over the duration of the lease of the property.

In a phone interview, Western Visayas police director Chief Superintendent Isagani Cuevas said the Boracay police chief deployed policemen to the compound of SandCastles resort to maintain peace and order.

Police said Hutchinson had leased the property from the original landowner, who was not immediately identified. The landowner had asked Hutchinson to vacate the property and later leased the property to businesswoman Evangeline Dizon-Danilo for 19 years.

Cuevas said the tension worsened after armed security guards were posted at the resort to harass the other claimants.

He warned all the contesting parties to instruct their armed security guards to leave the premises or all of them will be arrested.

“It’s a relief that the armed security guards left, so our policemen will stay there to maintain peace and order. It’s a legal issue and both parties should get directive from the court.” - Cecille Suerte Felipe

It’s such as nice experience to visit again Boracay. My second visit was on 27th of September – 29th , it was a treat of the company and we stayed at Mandarin Resort.  Even though it is raining and the weather is not good, still the staffs of the resort welcome us very warm. I really like Ms. Marlow because she is so accommodating. The resort has excellent service and very nice rooms. We had the opportunity to see the different rooms of the resort and I like the Deluxe Room with sea view.  We stayed at the family room and the room is spacious and has a good amenities. They also served superb food and at night the have a live band performing on their restaurant. The resort as well has pool and kids will surely enjoy staying at this kind of resort.  I give a star for this resort and surely recommend it to our guest.

I and my office mate when to Boracay 2 weeks ago. First night, we stayed in Deluxe Room with private verandah. The room is very nice, big and clean with complete amenities, almost perfect.  From verandah it’s really good that you can able to view the ocean. On the second night, we stayed at Family Room because my other companion was arrived. The room is good and big too. The staff of Boracay Mandarin is very accommodating and kind they even serve breakfast in room if you request. If, I’m given a second chance to go to Boracay again I would like to stay at Boracay Mandarin.

What can I say about Boracay Island? It’s really amazing and beautiful Beach because of its white sand and clear water. Not only the Island is good but also the people live and work there, they are friendly and chatty.

In the last month several media releases issued by Boracay sea transport association, CBTMPC, have accused Montenegro Lines, which operates two fast crafts between the jetty ports of Caticlan and Cagban, of unfair practices and draining the members of the transport associations of their income.

The Philippine Chamber of Commerce and Industry-Boracay, PCCI-Boracay, takes a contrary view. We at PCCI-Boracay support all efforts to upgrade land and sea transport toward world-class standards. We believe that CBTMPC should also take these new developments as a positive challenge to upgrade the facilities and services of its members.

Indeed, there is an urgent need for a modern, fast, safe, efficient, affordable, and weather-proof transport system for Boracay Island. In this regard, PCCI-Boracay is encouraging all existing transport system providers to upgrade all their services and facilities. This upgrade is essential to cater to the increasing volume of commuters and visitors in and around Boracay Island. We echo the concern repeatedly voiced by our public officials – our Mayor, Governor, Congressman, and DOJ Secretary – for efficient transport systems that meet the expectations and standards of visitors that come from within our country and from all over the world.

Upgrading the transport systems to word-class standards will boost tourism volume, along with the concomitant growth in business, improvement of income, and general progress in the region.

Better transport systems spell progress for Boracay Island.

Hello everyone, I just arrived back from Boracay Island. I spent 4 days and 3 nights at the lovely Artista Beach Resort up on Diniwid Beach. On our arrival of September 12, 2008 the weather was not great, it was quite stormy. However by the following morning it was, "HOT" really hot. But isn't that what we expect from a tropical Island?

Artista Boracay Resort (http://www.boracaycentral.com/artista.html) was great, we enjoyed the Deluxe Room on the Beach, the breakfast was very delicious, as was the lunch and dinner.

We used SOUTHWEST TOURS for our transfers, they were right on time and there new vans are terrific.

Thanks ARTISTA! Smiley
